2. Services Overview

Bongadesk provides customer relationship management tools, communication modules (SMS, email, live chat), task automation, meeting scheduling, reminders, file storage, payments management, and analytics designed to improve customer engagement and operational efficiency. The Services may be accessed through web or mobile applications.

3. Account Registration & Responsibilities

To use Bongadesk, you must create an account. You are responsible for safeguarding your login credentials and all activities that occur under your account. You agree to provide accurate and up-to-date information and to promptly update it when necessary. Bongadesk is not liable for loss or damage resulting from unauthorized access caused by your negligence.

4. Use of Services

You agree to use Bongadesk only for lawful business purposes. You may not:

  • Use Bongadesk to send spam or unauthorized messages.
  • Upload or share unlawful, harmful, or confidential content without authorization.
  • Reverse engineer, copy, or resell Bongadesk’s software or components.
  • Interfere with system integrity, security, or performance of the platform.

5. Data Collection & Privacy

Bongadesk collects information such as your name, contact details, organization information, activity logs, communication records, and device information. This data is used to deliver and improve the Services, support your account, and provide analytics. Data is processed in accordance with our Privacy Policy.

6. Subscription, Billing & Payments

Bongadesk is offered under various user-based subscription plans. A free trial may be provided for a limited time, after which payment is required to continue use. Fees must be paid as per the billing schedule selected (monthly, quarterly, semi-annual, or annual). Non-payment may result in suspension or termination of access.

7. Intellectual Property

All Bongadesk software, branding, documentation, and content are owned by Bongadesk or its licensors. You are granted a limited, non-transferable license to use the Services solely for your organization’s internal operations. Reproduction, distribution, or modification without written consent is prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, Bongadesk shall not be liable for any indirect, incidental, consequential, or special damages, including loss of revenue, data, or business opportunities, arising from your use or inability to use the Services. Your sole remedy is to discontinue use of the Services.

9. Termination

Bongadesk may suspend or terminate your account for violation of these Terms or unlawful use of the platform. Upon termination, your access to Services will cease, but data retention or deletion will follow the Privacy Policy.

Bongadesk reserves the right to modify, suspend, or discontinue parts of the Service at any time, including pricing or features, with reasonable notice where possible.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
